De Minimis Regulations
GUIDANCE ON WORK THAT MAY BE UNDERTAKEN WITHOUT A FACULTY
The Chancellor of each diocese publishes written guidance detailing matters of a minor nature that may be undertaken without a faculty. Minor works of repair and maintenance can therefore be carried out quickly without unnecessary bureaucracy. This guidance (usually referred to as De Minimis Regulations) varies slightly from diocese to diocese. For a copy of the guidance for your diocese, please contact your DAC Secretary or Diocesan Registrar.
Work listed in the guidance may legally be undertaken without a faculty. In some dioceses, the list is divided into two sections - for certain items the DAC and the Archdeacon have to give their approval prior to work commencing.
The carrying out of work that is outside the Chancellor's guidance without a faculty is unlawful, and may be subject to enforcement action. If you are in any doubt or if you are a new churchwarden, telephone the DAC Secretary or Archdeacon to check that a faculty is not required.
